General.
The OWASP Foundation ("OWASP") provides articles, methodologies, documentation, tools, and technologies (“OWASP Materials') dedicated to finding and fighting the causes of insecure software. The OWASP Materials are licensed, not sold, to you by OWASP for use only under the terms of this License, and OWASP reserves all rights not expressly granted to you.
Grant of Limited Rights.
While you remain a member in good standing and comply with all the terms of this license, OWASP hereby grants you the right to distribute, modify, and use the OWASP Materials within your organization, whether by manual or electronic means. You acknowledge and agree that the foregoing grant is subject to the terms of your membership arrangement with OWASP and may, therefore, be modified or terminated by OWASP at any time.
Transfer.
You may not rent, lease, redistribute, sublicense, or otherwise transfer the limited rights granted by this license.
Redistribution.
The OWASP Materials are protected by copyright and other intellectual property laws and by international treaties. You acknowledge and agree that you are not acquiring title to any intellectual property rights in OWASP Materials. You may improve the materials and distribute modified versions within your organization. Distribution outside your organization must be according to the terms of the open source license associated with the project.
No Warranty.
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE OWASP MATERIALS IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY AND EFFORT IS WITH YOU. THE OWASP MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE" AND WITHOUT ANY WARRANTY OR REPRESENTATION WHATSOEVER, EXPRESS OR IMPLIED. OWASP SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, AND FITNESS FOR A PARTICULAR PURPOSE.
Limitation of Liability.
TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL OWASP BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE OWASP MATERIALS, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT OR OTHERWISE) AND EVEN IF OWASP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. In no event shall OWASP's total liability to you for all damages exceed the amount of fifty dollars ($50.00). The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.
Choice of Law; Jurisdiction; Venue.
You acknowledge and agree that these Agreed Terms of Use will be governed by and construed in accordance with the laws of the State of Maryland, that any action at law or in equity arising out of or relating to these Agreed Terms of Use shall be filed only in the courts located in the State of Maryland, that you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action. If any of these Agreed Terms of Use shall be determined to be unlawful, void, or for any reason unenforceable, then such terms shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.
Complete Agreement; Governing Language.
This License constitutes the entire agreement between the parties with respect to the use of the OWASP Materials licensed hereunder and supersedes all prior or contemporaneous understandings regarding such subject matter. No amendment to or modification of this License will be binding unless in writing and signed by OWASP.
YOU ACKNOWLEDGE THAT YOU HAVE READ THESE AGREED TERMS OF USE IN THEIR ENTIRETY, UNDERSTAND THEM, AND YOU AGREE TO BE BOUND BY THEM IN ALL RESPECTS.
